Flaws of Pakistani justice system
1:- Incident and its initial investigation
To present an overview of the Pakistani justice system, we take before you a case of murder in an area as a test. For example, today someone left home and got killed.
Discovered/Flaws of Pakistani justice system-thinkangle-2023 |
A:- The first time the police received the report, the police picked up the body from the accident site and sent it to the hospital for post-martum.
B:- The relatives came to the police station and filed the initial report as if they were present at the accident site. And they also knew with what the killer had killed. It is not possible that if a loved one is being murdered and he stands by and watches only to make it easier for him to file a police report.
C:- The police then collect the evidence from the accident site. And an inspector is hired for this work. The qualification of this inspector is barely metric or intermediate. The preliminary investigation of this very sensitive matter is further discussed in the concerned court.
D:- The investigator arrests the murderer and asks him for instrumental murder. If the relatives have written the instrument of murder wrongly, then the killer will kill with the same instrument. Although the killer did not act with this murder device. And the post-martom report comes to the contrary. Thus the killer benefits.
2:- Judicial proceedings and decision
Now the case is scheduled for discussion in court. So the lawyers for the accused and the plaintiff start arguing. One thing to note here is that the FIR was filed by an uneducated person and the person who wrote the report and conducted the initial investigation is a metric. If the lawyer of the accused is L-L-B or L-L-M, then the chances of getting justice are reduced. Another thing must be mentioned that if the FIR, postmortem report, uneducated witnesses. If there is even an iota of discrepancy between the statement and the preliminary investigation report, the killer will be acquitted. While delivering justice, the judge is not concerned with the public opinion in the victim's area and the failure of the police. The police and court have no intelligence system. If there is, it is available for high profile cases. Otherwise, if the murderer is considered guilty and sentenced. He appeals to the Supreme Court.
3:- Appeal to the Supreme Court
Proceedings on appeal in this court start after two years. First, half of the witnesses in the case are dead, otherwise the only function of this court is to find loopholes in the judgment of the subordinate court. Second, this court is unfortunately hundreds of kilometers away from the accident site. The screams of the relatives of the deceased cannot reach there. And thus the murderer is either acquitted or receives only symbolic punishment.
4:- Decision of Supreme Court
In the light of all the evidence and statements of the witnesses, this court has come to the conclusion that the accused So-and-so is innocent and the accused is honorably acquitted. The Court by X-Y-Z. Now, the honorable judge should have said that the murder was committed by some other creature from the sky. And yes, they would also have apologized to the accused that you were innocent and were imprisoned for ten to twelve years because of our incompetence.
5:- Expenses of obtaining justice
The case lasts three years in the subordinate court. This court may be thirty kilometers away from the victim's house. Heavy lawyers' fees and on the other hand the economic gap in the victim's home after the death can become a hindrance to justice.
6:- A look at lawyers
I have never heard in my forty years of life that such and such a lawyer refused to take someone's case simply because the accused had actually committed a sin and the lawyer did not practice false advocacy. Rather, everything here is halal.
7:- The distinction between the rich and the poor
In Pakistan the Supreme Court in part and the Supreme Court in particular are busy day and night for political and high profile cases. Dozens of defamation cases are pending. If someone is becoming ineligible, then a politician has become eligible. All the media collect millions of news in a day in Islamabad of twenty five acres.
8:- Execution is prohibited
There is an unannounced ban on executions in Pakistan. If we fulfill the demands of justice in our country, the West may be angry. Hajjaj-bin-Yousuf said in the Jamia-Mosque of Kufa-city that "I see that the harvest of many people's heads is ripe". Something similar has happened in our beloved country Pakistan. Insha Allah the time is very near when justice will start working. The world is based on hope and despair is disbelief.
